1. Acceptance of Terms
By accessing or using the MarriageWorks.TODAY website, mobile application, or any associated services (collectively, the "Platform"), you agree to be bound by these Terms & Conditions ("Terms"). Please read them carefully before using our Platform. If you do not agree with any part of these Terms, you must not access or use our services.
These Terms constitute a legally binding agreement between you ("User", "you", or "your") and MarriageWorks.TODAY Ltd, a company registered in England and Wales. We reserve the right to modify these Terms at any time, and we will notify you of significant changes via email or prominent notice on the Platform.
Your continued use of the Platform following any changes to these Terms constitutes your acceptance of the revised Terms. It is your responsibility to check this page periodically for updates. The date at the top of this page indicates when these Terms were last revised.
2. Use of the Platform
You may use the Platform solely for lawful personal, non-commercial purposes in accordance with these Terms. You agree not to use the Platform in any way that violates any applicable local, national, or international law or regulation, or in any way that is fraudulent, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable.
You must not attempt to gain unauthorised access to any part of the Platform, its related systems, or networks. You must not transmit any unsolicited or unauthorised advertising or promotional material, or any other form of similar solicitation (spam). Any breach of these usage conditions may result in immediate suspension or termination of your account.
We reserve the right to withdraw or amend any service we provide on the Platform without notice. We will not be liable if, for any reason, the Platform is unavailable at any time or for any period. From time to time, we may restrict access to some or all of the Platform to users who have registered with us.
3. User Accounts
To access certain features of the Platform, you must register for an account. When you register, you agree to provide accurate, current, and complete information about yourself, and to maintain and promptly update that information to keep it accurate and complete. You are responsible for safeguarding your password and for all activities that occur under your account.
You must notify us immediately at support@marriageworks.today if you suspect any unauthorised use of your account or any other breach of security. We will not be liable for any loss or damage arising from your failure to comply with this security obligation.
We reserve the right to disable any user account at our discretion, including if we believe you have violated any provision of these Terms. Upon termination of your account for any reason, your right to use the Platform will immediately cease, though certain provisions of these Terms will survive termination.
4. Intellectual Property
The Platform and all of its original content, features, and functionality, including but not limited to text, graphics, logos, images, audio clips, digital downloads, data compilations, and software, are owned by MarriageWorks.TODAY Ltd or its content suppliers and are protected by United Kingdom and international copyright, trademark, patent, trade secret, and other intellectual property laws.
You are granted a limited, non-exclusive, non-transferable licence to access and use the Platform for your personal, non-commercial use only. This licence does not include the right to reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Platform without our prior written consent.
If you believe that any content on the Platform infringes your intellectual property rights, please notify us at legal@marriageworks.today with full details of the alleged infringement. We take intellectual property rights seriously and will respond to valid notices in accordance with applicable law.
5. Privacy & Data
Your use of the Platform is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Our Privacy Policy explains how we collect, use, and protect your personal data in compliance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.
By using our Platform, you consent to the collection and use of your information as described in our Privacy Policy. We encourage you to review our Privacy Policy carefully before providing us with any personal data.
We take the security and privacy of your personal data very seriously. We implement appropriate technical and organisational measures to protect your data against unauthorised access, loss, or destruction. For more information, please read our full Privacy Policy.
6. Payment Terms
Certain services offered through the Platform require payment. All prices are displayed in British Pounds Sterling (GBP) and are inclusive of VAT where applicable. By providing your payment information, you authorise MarriageWorks.TODAY Ltd to charge your payment method for all fees and applicable taxes.
Subscription fees are billed in advance on a recurring basis (monthly or annually, as selected). You may cancel your subscription at any time, but we do not provide refunds for partial billing periods unless required by applicable law. Free trial periods, where offered, will automatically convert to paid subscriptions unless cancelled before the trial ends.
If payment cannot be processed for any reason, we reserve the right to suspend or terminate your access to paid services. All transactions are processed securely through our third-party payment processor. We do not store your full payment card details on our servers.
7. Disclaimer of Warranties
The Platform and all content, services, and products available through the Platform are provided on an "as is" and "as available" basis without any warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
MarriageWorks.TODAY Ltd does not warrant that the Platform will be uninterrupted, secure, or error-free, that defects will be corrected, or that the Platform or the servers that make it available are free of viruses or other harmful components. We make no warranty regarding the quality, accuracy, timeliness, truthfulness, completeness, or reliability of any content available through the Platform.
The information and resources provided on the Platform are for educational and informational purposes only and do not constitute professional therapeutic, legal, financial, or medical advice. MarriageWorks.TODAY Ltd is not a regulated therapy or counselling provider. If you require professional advice, please consult a qualified practitioner.
8. Limitation of Liability
To the fullest extent permitted by applicable law, MarriageWorks.TODAY Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of data, loss of goodwill, service interruption, computer damage or system failure, arising out of or in connection with your use of, or inability to use, the Platform.
In no event shall our total liability to you for all claims arising out of or relating to these Terms or the use of the Platform exceed the greater of (a) the total amount paid by you to us in the twelve-month period preceding the claim, or (b) £100.
Some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, so the above limitations may not apply to you. Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under English law.
9. Governing Law (England & Wales)
These Terms and any dispute or claim arising out of or in connection with them (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of England and Wales. You and MarriageWorks.TODAY Ltd both agree to submit to the exclusive jurisdiction of the courts of England and Wales.
If any provision of these Terms is held by a court to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and MarriageWorks.TODAY Ltd regarding the use of the Platform, and supersede all prior and contemporaneous written or oral agreements between you and us.
